شروط الاستخدام

1. مَن يُشغّل التطبيق

تطبيق «سليم» («التطبيق») تُشغّله Santa Media نيابةً عن د. أحمد الخطيب، وهو صيدلي إكلينيكي معتمد (دكتوراه صيدلة). وتعني كلمة «نحن» في هذه الشروط شركة Santa Media.

2. قبول هذه الشروط

بإنشائك حسابًا أو باستخدامك التطبيق، فإنك توافق على شروط الاستخدام هذه وعلى سياسة الخصوصية الخاصة بنا. وإن كنت لا توافق، فيُرجى عدم استخدام التطبيق.

3. الأهلية والسنّ

يجب ألا يقلّ عمرك عن 13 عامًا لاستخدام التطبيق. وإذا كنت دون 18 عامًا، فلا يجوز لك استخدام التطبيق إلا بموافقة وإشراف وليّ أمرك أو الوصيّ القانوني، الذي يقبل هذه الشروط نيابةً عنك.

4. حسابك

• أنت مسؤول عن الحفاظ على سرّية بيانات دخولك وعن أي نشاط يجري عبر حسابك.
• حساب واحد لكل شخص. لا تشارك حسابك مع غيرك.
• قدّم معلومات دقيقة، وحافظ على تحديث ملفك الشخصي ليعمل التطبيق على نحو صحيح.

5. إخلاء المسؤولية الطبية — يُرجى القراءة

• د. أحمد الخطيب صيدلي إكلينيكي، وليس طبيبًا. ولا يُغني أي محتوى في التطبيق عن رعاية طبيب مرخّص.
• قد تكون تقديرات الذكاء الاصطناعي خاطئة. فتقديرات السعرات والعناصر الغذائية والخطط المُنشأة آليًا ما هي إلا نقطة بداية تحتاج إلى مراجعة مختصّ، خصوصًا إذا كانت لديك حالة مرضية مثل السكري، أو الحمل، أو مشكلات الكلى أو ضغط الدم، أو أي خطر يتعلق باضطرابات الأكل.
• استشر طبيبك دائمًا قبل إجراء أي تغيير كبير في نظامك الغذائي أو نشاطك البدني أو أدويتك.
• تنبيه الطوارئ: التطبيق ليس مخصّصًا لحالات الطوارئ. إذا واجهت حالة طبية طارئة، فاتصل فورًا بخدمات الطوارئ في بلدك.

6. الاشتراكات والمدفوعات

• يوفّر التطبيق باقة مجانية وباقات مدفوعة، إضافةً إلى عمليتي شراء لمرة واحدة (VIP صوتي وVIP مرئي) لجلسة مباشرة مع د. أحمد الخطيب.
• تظهر الأسعار الحالية داخل التطبيق عند الدفع. وقد تختلف الأسعار حسب المتجر والمنطقة، وقد تتغيّر مع الوقت.
• تُحصَّل قيمة الباقات المدفوعة وعمليات الشراء لمرة واحدة عبر مزوّد الدفع الخاص بالتطبيق.
• يمكنك إدارة أي باقة مدفوعة أو إلغاؤها في أي وقت من حسابك أو بمراسلتنا. وإن كانت الباقة قابلة للتجديد، فسنذكّرك قبل التجديد؛ وإذا ألغيت، يبقى وصولك حتى نهاية المدة التي دفعت مقابلها.
• تُعالَج عمليات الاسترداد بما يتوافق مع القانون المعمول به وسياساتنا؛ للطلبات راسلنا على support@saliim.co.
• سنُشعِرك مسبقًا بأي تغيير في سعر أي باقة مدفوعة.

7. جلسات VIP مع د. أحمد الخطيب

• باقتا VIP الصوتية والمرئية هما عمليتا شراء لمرة واحدة تتضمّنان فترة متابعة مُجمَّعة وتوجّهانك مباشرةً إلى د. أحمد الخطيب.
• تُحجَز جلسات VIP مباشرةً عبر التطبيق.
• إذا تعذّر على د. أحمد حضور جلسة محجوزة، فسنعيد جدولتها في أقرب موعد متاح أو نردّ قيمة الشراء.
• لا تُسجَّل الجلسات إلا بموافقتك الصريحة أثناء المكالمة. والوضع الافتراضي هو عدم التسجيل.

8. الاستخدام المقبول

أنت توافق على ألا:

• تعكس هندسة التطبيق أو تكشط بياناته أو تتجاوز حدود الحصص أو الوصول.
• ترفع صورًا أو معلومات عن أشخاص آخرين دون موافقتهم.
• تضايق الموظفين أو المستخدمين الآخرين، أو تسيء استخدام ميزات الاستشارة.
• تُعيد بيع التطبيق أو محتواه أو توزيعه أو تستغلّه تجاريًا.
• تستخدم التطبيق لأي غرض غير قانوني.

9. محتواك والترخيص الممنوح لنا

• تحتفظ بملكية الصور والملاحظات والمعلومات الصحية وغيرها من المحتوى الذي تقدّمه.
• تمنحنا ترخيصًا محدودًا غير حصري لمعالجة محتواك لغرض تقديم الخدمة فقط — بما في ذلك التحليل بالذكاء الاصطناعي، وإنشاء الخطط، والتفريغ النصّي، ومراجعة فريق الرعاية المخصّص لك — على النحو الموضّح في سياسة الخصوصية.

10. الملكية الفكرية

التطبيق وتصميمه والعلامة التجارية «سليم» وقوالب الخطط ومحتوى د. أحمد المُعلَّم بعلامته مملوكة لنا أو لمرخِّصينا، ومحميّة بموجب القانون. وأنت تحصل على ترخيص شخصي غير قابل للنقل وقابل للإلغاء لاستخدام التطبيق في غرضه المقصود.

11. خدمات الأطراف الأخرى

يعتمد التطبيق على مزوّدين خارجيين (من بينهم Supabase، وGoogle Cloud / Vertex AI، وFirebase Cloud Messaging، وAgora، وTap Payments، وSentry). وقد يخضع استخدامك لهذه الميزات أيضًا لشروط هؤلاء المزوّدين. ولسنا مسؤولين عن خدمات الأطراف الأخرى التي لا نتحكّم فيها.

12. إخلاء الضمانات

يُقدَّم التطبيق «كما هو» و«بحسب توافره»، دون أي ضمانات صريحة أو ضمنية، بما في ذلك الملاءمة لغرض معيّن. ولا نضمن أن يكون التطبيق متواصلًا دون انقطاع أو خاليًا من الأخطاء، ولا أن يحقّق أي تقدير أو خطة نتيجةً معيّنة.

13. حدود المسؤولية

إلى أقصى حدّ يسمح به القانون، لا نتحمّل المسؤولية عن أي أضرار غير مباشرة أو عرضية أو خاصة أو تبعية، ولا عن خسائر ناتجة عن انقطاع الشبكة أو خدمات الأطراف الأخرى. وتقتصر مسؤوليتنا الإجمالية عن أي مطالبة على المبلغ الذي دفعته مقابل التطبيق خلال 12 شهرًا السابقة للمطالبة.

14. التعويض

توافق على تعويضنا وإبراء ذمّتنا من أي مطالبات تنشأ عن سوء استخدامك للتطبيق، أو مخالفتك لهذه الشروط، أو انتهاكك لحقوق أي طرف آخر.

15. الإيقاف والإنهاء وحذف الحساب

• يجوز لنا إيقاف الوصول أو إنهاؤه في حال إساءة الاستخدام أو الاحتيال أو مخالفة هذه الشروط.
• يمكنك التوقّف عن استخدام التطبيق وحذف حسابك في أي وقت من الإعدادات / الحساب ← حذف الحساب؛ ويسري الحذف فورًا وهو غير قابل للتراجع. ويمكنك أيضًا حذف حسابك عبر saliim.co/account-deletion.html أو بمراسلتنا على support@saliim.co.

16. القانون الحاكم

تخضع هذه الشروط لقوانين جمهورية مصر العربية، دون اعتبار لقواعد تنازع القوانين.

17. التغييرات على هذه الشروط

يجوز لنا تحديث هذه الشروط. وسيُعلَن عن التغييرات الجوهرية داخل التطبيق، ويُحدَّث التاريخ أعلاه. واستمرارك في الاستخدام بعد التغيير يعني قبولك للشروط المحدَّثة.

19. شروط إضافية خاصة بمتجر Apple App Store

تُطبَّق هذه الشروط الإضافية عند تنزيلك التطبيق من متجر Apple App Store:

• هذه الشروط مبرمة بينك وبين Santa Media فقط، وليست مع Apple. وApple ليست مسؤولة عن التطبيق أو محتواه.
• لا تتحمّل Apple أي التزام بتقديم أي صيانة أو دعم للتطبيق.
• إلى الحدّ الذي يسمح به القانون، لا تتحمّل Apple أي التزام بالضمان بخصوص التطبيق، وتقع علينا — لا على Apple — مسؤولية أي مطالبات تتعلق بالتطبيق (بما في ذلك مطالبات المسؤولية عن المنتج، أو الامتثال القانوني والتنظيمي، أو حماية المستهلك).
• تُعدّ Apple وشركاتها التابعة مستفيدة كطرف ثالث من هذه الشروط، ويحقّ لها إنفاذها تجاهك.
• تُقرّ بأنك لست موجودًا في بلد يخضع لحظر من حكومة الولايات المتحدة أو مُصنَّف بأنه «داعم للإرهاب»، وبأنك لست مُدرَجًا على أي قائمة حكومية أمريكية للأطراف المحظورة أو المقيّدة.

1. Who operates the app

The Saliim app ("the app") is operated by Santa Media on behalf of Dr. Ahmed Elkhateeb, a certified clinical pharmacist (Pharm.D). In these Terms, "we", "us", and "our" mean Santa Media.

2. Acceptance of these terms

By creating an account or using the app, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the app.

3. Eligibility and age

You must be at least 13 years old to use the app. If you are under 18, you may use the app only with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf.

4. Your account

• You are responsible for keeping your login credentials secure and for activity under your account.
• One account per person. Do not share your account.
• Provide accurate information; keep your profile up to date so the service works correctly.

5. Medical disclaimer — please read

• Dr. Ahmed Elkhateeb is a clinical pharmacist, not a physician (medical doctor). Nothing in the app is a substitute for care from a licensed physician.
• AI estimates can be wrong. Calorie and macro estimates and automatically generated plans are starting points only, and require professional review — especially if you have a medical condition such as diabetes, pregnancy, kidney or blood-pressure issues, or any eating-disorder risk.
• Always consult your own physician before making significant changes to your diet, exercise, or medication.
• Emergency notice: the app is not for emergencies. If you have a medical emergency, call your local emergency services immediately.

6. Subscriptions and payments

• The app offers a free tier and paid tiers, plus one-time VIP Audio and VIP Video purchases for a direct session with Dr. Ahmed.
• Current prices are shown in the app at checkout. Prices may differ by store and region and may change over time.
• Paid tiers and one-time purchases are billed through the app's payment provider.
• You can manage or cancel a paid plan at any time from your account, or by contacting us. If a plan is set to renew, we will remind you beforehand; if you cancel, you keep access until the end of the period you have already paid for.
• Refunds are handled in line with applicable law and our refund practices; contact support@saliim.co for refund requests.
• We will give you advance notice before any change to the price of a paid plan.

7. VIP sessions with Dr. Ahmed

• VIP Audio and VIP Video are one-time purchases that include a bundled follow-up window and route you directly to Dr. Ahmed.
• VIP sessions are scheduled directly through the app.
• If Dr. Ahmed cannot attend a scheduled session, we will reschedule it at the next available slot or refund the purchase.
• Sessions are recorded only with your explicit in-call consent. The default is no recording.

8. Acceptable use

You agree not to:

• Reverse-engineer, scrape, or bypass quota or access limits.
• Upload photos or information about other people without their consent.
• Harass staff or other users, or misuse the consultation features.
• Resell, redistribute, or commercially exploit the app or its content.
• Use the app for any unlawful purpose.

9. Your content and license to us

• You keep ownership of the photos, notes, health information, and other content you submit.
• You grant us a limited, non-exclusive license to process your content solely to provide the service — including AI analysis, plan generation, transcription, and review by your assigned care team — as described in the Privacy Policy.

10. Intellectual property

The app, its design, the brand "Saliim", plan templates, and Dr. Ahmed's branded content are owned by us or our licensors and are protected by law. You receive a personal, non-transferable, revocable license to use the app for its intended purpose.

11. Third-party services

The app relies on third-party providers (including Supabase, Google Cloud / Vertex AI, Firebase Cloud Messaging, Agora, Tap Payments, and Sentry). Your use of these features may also be subject to those providers' terms. We are not responsible for third-party services we do not control.

12. Disclaimers

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted, error-free, or that any estimate or plan will achieve a specific result.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for losses arising from network outages or third-party services. Our total liability for any claim is limited to the amount you paid for the app in the 12 months before the claim.

14. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the app, your violation of these Terms, or your infringement of any third party's rights.

15. Suspension, termination, and account deletion

• We may suspend or terminate access for abuse, fraud, or violation of these Terms.
• You may stop using the app and delete your account at any time from Settings / Account → Delete account; deletion takes effect immediately and is irreversible. You can also delete your account at saliim.co/account-deletion.html or by emailing support@saliim.co.

16. Governing law

These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-law rules.

17. Changes to these terms

We may update these Terms. Material changes will be announced in the app and the date above will be updated. Continued use after a change means you accept the updated Terms.

19. Apple App Store — additional terms

These additional terms apply when you download the app from the Apple App Store:

• These Terms are between you and Santa Media only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide any maintenance or support for the app.
• To the extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims relating to the app (including product liability, legal or regulatory compliance, or consumer-protection claims) are our responsibility, not Apple's.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
