شروط الاستخدام

1. مالك التطبيق

تطبيق «سليم» («التطبيق») هو تطبيق استهلاكي لنمط الحياة والتغذية اليومية، ومملوك لشركة SANTA CO L.L.C-FZ. يستضيف أحمد الخطيب بعض تجارب VIP. وتعني كلمات «نحن» و«لنا» و«الخاص بنا» في هذه الشروط شركة SANTA CO L.L.C-FZ.

2. قبول هذه الشروط

بإنشائك حسابًا أو باستخدامك التطبيق، فإنك توافق على شروط الاستخدام هذه وعلى سياسة الخصوصية الخاصة بنا. وإن كنت لا توافق، فيُرجى عدم استخدام التطبيق.

3. الأهلية والسنّ

يجب ألا يقلّ عمرك عن 13 عامًا لاستخدام التطبيق. وإذا كنت دون 18 عامًا، فلا يجوز لك استخدام التطبيق إلا بموافقة وإشراف وليّ أمرك أو الوصيّ القانوني، الذي يقبل هذه الشروط نيابةً عنك.

4. حسابك

• أنت مسؤول عن الحفاظ على سرّية بيانات دخولك وعن أي نشاط يجري عبر حسابك.
• حساب واحد لكل شخص. لا تشارك حسابك مع غيرك.
• قدّم معلومات دقيقة، وحافظ على تحديث ملفك الشخصي ليعمل التطبيق على نحو صحيح.

5. نطاق استخدام نمط الحياة

• قد تكون تقديرات الذكاء الاصطناعي غير دقيقة. فتقديرات السعرات والعناصر الغذائية والخطط المُنشأة آليًا نقاط بداية تعليمية وليست نتائج مضمونة.
• لأي احتياج يتجاوز التغذية اليومية العامة ونمط الحياة، اطلب مساعدة مهنية مستقلة مناسبة.

6. الاشتراكات والمدفوعات

• يوفّر التطبيق باقة مجانية وعضويات كوتشينج مدفوعة، إضافةً إلى تجربتي VIP صوتية ومرئية لمرة واحدة يستضيفهما أحمد الخطيب.
• تظهر الأسعار الحالية داخل التطبيق. يعرض الكتالوج العام الحالي الأسعار بالدولار الأمريكي، وقد تتغيّر الأسعار مع الوقت.
• الدفع متاح حاليًا بالتحويل البنكي خارج التطبيق. وبعد إتمام اعتماد حساب التاجر واختبارات الإنتاج، قد نتيح الدفع بالبطاقة من خلال صفحة Tap Payments آمنة داخل شاشة دفع مدمجة في سليم، من دون توجيه المستخدم عمدًا إلى متصفح خارجي. وقد تعرض الجهة المصدرة للبطاقة أو المحفظة واجهة مصادقة خاصة بها قبل العودة إلى سليم. لا نستلم أو نخزّن رقم بطاقتك الكامل أو رمز الأمان؛ تتولى Tap معالجة بيانات البطاقة.
• لا تتجدّد أي باقة تلقائيًا، ولا يُسحَب منك أي مبلغ تلقائيًا في النموذج الحالي. كل تجديد هو عملية دفع جديدة تختار أنت أن تقوم بها. نذكّرك قبل انتهاء المدة بـ 7 أيام و3 أيام ويوم واحد، وبعد انتهائها تستمر مزايا الباقة 3 أيام سماح ثم يعود حسابك إلى الباقة المجانية. وإذا لم تُجدِّد، تنتهي الباقة من نفسها.
• تُعالَج عمليات الاسترداد بما يتوافق مع القانون المعمول به وسياساتنا؛ للطلبات راسلنا على support@saliim.co.
• سنُشعِرك مسبقًا بأي تغيير في سعر أي باقة مدفوعة.

7. تجارب VIP لنمط الحياة

• VIP الصوتية والمرئية عمليتا شراء لمرة واحدة تتضمّنان لقاء نمط حياة يستضيفه أحمد الخطيب وفترة كوتشينج مُجمَّعة.
• تُحجَز لقاءات VIP مباشرةً عبر التطبيق.
• إذا تعذّر على أحمد الخطيب حضور لقاء محجوز، فسنعيد جدولته في أقرب موعد متاح أو نردّ قيمة الشراء.
• لا تُسجَّل اللقاءات إلا بموافقتك الصريحة أثناء المكالمة. والوضع الافتراضي هو عدم التسجيل.

8. تسجيل مكالمات الكوتشينج وتفريغها

قد تُسجَّل وتُفرَّغ نصّيًّا — بموافقتك الصريحة أثناء المكالمة — مكالمات الكوتشينج الفردية الصوتية والمرئية، وذلك لأغراض جودة الخدمة والمتابعة والمراجعة الداخلية فقط. وتُستخدم لإعداد أهدافك ومتابعتها، وتُحفَظ بشكل خاص وآمن لأجل فريق الخدمة المخصّص لك، ولا تُشارَك مع أي جهة خارجية، كما هو موضّح في سياسة الخصوصية.

9. الاستخدام المقبول

أنت توافق على ألا:

• تعكس هندسة التطبيق أو تكشط بياناته أو تتجاوز حدود الحصص أو الوصول.
• ترفع صورًا أو معلومات عن أشخاص آخرين دون موافقتهم.
• تضايق الموظفين أو المستخدمين الآخرين، أو تسيء استخدام ميزات الكوتشينج.
• تُعيد بيع التطبيق أو محتواه أو توزيعه أو تستغلّه تجاريًا.
• تستخدم التطبيق لأي غرض غير قانوني.

10. محتواك والترخيص الممنوح لنا

• تحتفظ بملكية الصور والملاحظات ومعلومات ملفك الشخصي وغيرها من المحتوى الذي تقدّمه.
• تمنحنا ترخيصًا محدودًا غير حصري لمعالجة محتواك لغرض تقديم الخدمة فقط — بما في ذلك التحليل بالذكاء الاصطناعي، وإنشاء الخطط، والتفريغ النصّي، ومراجعة فريق الخدمة المخصّص لك — على النحو الموضّح في سياسة الخصوصية.

11. الملكية الفكرية

التطبيق وتصميمه والعلامة التجارية «سليم» وقوالب الخطط والمحتوى المرتبط بأحمد الخطيب مملوكة لنا أو لمرخِّصينا، ومحميّة بموجب القانون. وأنت تحصل على ترخيص شخصي غير قابل للنقل وقابل للإلغاء لاستخدام التطبيق في غرضه المقصود.

12. خدمات الأطراف الأخرى

يعتمد التطبيق على مزوّدين خارجيين (من بينهم Supabase، وGoogle Cloud / Vertex AI، وFirebase Cloud Messaging، وAgora، وSentry). وقد يخضع استخدامك لهذه الميزات أيضًا لشروط هؤلاء المزوّدين. ولسنا مسؤولين عن خدمات الأطراف الأخرى التي لا نتحكّم فيها.

13. إخلاء الضمانات

يُقدَّم التطبيق «كما هو» و«بحسب توافره»، دون أي ضمانات صريحة أو ضمنية، بما في ذلك الملاءمة لغرض معيّن. ولا نضمن أن يكون التطبيق متواصلًا دون انقطاع أو خاليًا من الأخطاء، ولا أن يحقّق أي تقدير أو خطة نتيجةً معيّنة.

14. حدود المسؤولية

إلى أقصى حدّ يسمح به القانون، لا نتحمّل المسؤولية عن أي أضرار غير مباشرة أو عرضية أو خاصة أو تبعية، ولا عن خسائر ناتجة عن انقطاع الشبكة أو خدمات الأطراف الأخرى. وتقتصر مسؤوليتنا الإجمالية عن أي مطالبة على المبلغ الذي دفعته مقابل التطبيق خلال 12 شهرًا السابقة للمطالبة.

15. التعويض

توافق على تعويضنا وإبراء ذمّتنا من أي مطالبات تنشأ عن سوء استخدامك للتطبيق، أو مخالفتك لهذه الشروط، أو انتهاكك لحقوق أي طرف آخر.

16. الإيقاف والإنهاء وحذف الحساب

• يجوز لنا إيقاف الوصول أو إنهاؤه في حال إساءة الاستخدام أو الاحتيال أو مخالفة هذه الشروط.
• يمكنك التوقّف عن استخدام التطبيق وحذف حسابك في أي وقت من الإعدادات / الحساب ← حذف الحساب؛ ويسري الحذف فورًا وهو غير قابل للتراجع. ويمكنك أيضًا حذف حسابك عبر saliim.co/account-deletion.html أو بمراسلتنا على support@saliim.co.

17. القانون الحاكم

تخضع هذه الشروط لقوانين جمهورية مصر العربية، دون اعتبار لقواعد تنازع القوانين.

18. التغييرات على هذه الشروط

يجوز لنا تحديث هذه الشروط. وسيُعلَن عن التغييرات الجوهرية داخل التطبيق، ويُحدَّث التاريخ أعلاه. واستمرارك في الاستخدام بعد التغيير يعني قبولك للشروط المحدَّثة.

20. شروط إضافية خاصة بمتجر Apple App Store

تُطبَّق هذه الشروط الإضافية عند تنزيلك التطبيق من متجر Apple App Store:

• هذه الشروط مبرمة بينك وبين SANTA CO L.L.C-FZ فقط، وليست مع Apple. وApple ليست مسؤولة عن التطبيق أو محتواه.
• لا تتحمّل Apple أي التزام بتقديم أي صيانة أو دعم للتطبيق.
• إلى الحدّ الذي يسمح به القانون، لا تتحمّل Apple أي التزام بالضمان بخصوص التطبيق، وتقع علينا — لا على Apple — مسؤولية أي مطالبات تتعلق بالتطبيق (بما في ذلك مطالبات المسؤولية عن المنتج، أو الامتثال القانوني والتنظيمي، أو حماية المستهلك).
• تُعدّ Apple وشركاتها التابعة مستفيدة كطرف ثالث من هذه الشروط، ويحقّ لها إنفاذها تجاهك.
• تُقرّ بأنك لست موجودًا في بلد يخضع لحظر من حكومة الولايات المتحدة أو مُصنَّف بأنه «داعم للإرهاب»، وبأنك لست مُدرَجًا على أي قائمة حكومية أمريكية للأطراف المحظورة أو المقيّدة.

1. App ownership

The Saliim app ("the app") is a consumer lifestyle and everyday-nutrition app owned by SANTA CO L.L.C-FZ. Ahmed Elkhateeb hosts selected VIP experiences. In these Terms, "we", "us", and "our" mean SANTA CO L.L.C-FZ.

2. Acceptance of these terms

By creating an account or using the app, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the app.

3. Eligibility and age

You must be at least 13 years old to use the app. If you are under 18, you may use the app only with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf.

4. Your account

• You are responsible for keeping your login credentials secure and for activity under your account.
• One account per person. Do not share your account.
• Provide accurate information; keep your profile up to date so the service works correctly.

5. Lifestyle-use scope

• AI estimates may be inaccurate. Calorie and macro estimates and automatically generated plans are educational starting points, not guaranteed results.
• For needs outside everyday nutrition and lifestyle guidance, seek appropriate independent professional support.

6. Subscriptions and payments

• The app offers a free tier and paid coaching memberships, plus one-time VIP Audio and VIP Video experiences hosted by Ahmed Elkhateeb.
• Current prices are shown in the app. The current public catalogue is shown in US dollars and prices may change over time.
• Payment is currently available by bank transfer outside the app. After merchant approval and production testing, card payment may also be offered through Tap Payments' secure hosted page inside Saliim's embedded checkout view, without intentionally redirecting the user to an external browser. The issuing bank or wallet may display its own authentication interface before returning the user to Saliim. We do not receive or store your full card number or security code; Tap processes the card data.
• No plan renews automatically and no automatic recurring charge is made under the current model. Every renewal is a new payment you choose to make. We remind you 7 days, 3 days and 1 day before your period ends; after it ends your paid features continue for a 3-day grace period and your account then returns to the free tier. If you do not renew, the plan simply ends.
• Refunds are handled in line with applicable law and our refund practices; contact support@saliim.co for refund requests.
• We will give you advance notice before any change to the price of a paid plan.

7. VIP lifestyle experiences

• VIP Audio and VIP Video are one-time purchases that include a lifestyle conversation hosted by Ahmed Elkhateeb and a bundled coaching window.
• VIP experiences are scheduled directly through the app.
• If Ahmed Elkhateeb cannot attend a scheduled experience, we will reschedule it at the next available slot or refund the purchase.
• Calls are recorded only with your explicit in-call consent. The default is no recording.

8. Recording and transcription of coaching calls

One-to-one coaching calls (audio and video) may — with your explicit in-call consent — be recorded and transcribed for service quality, follow-through, and internal review only. These recordings and transcripts are used to prepare and follow up on your goals, are kept private and secure for your assigned service team, and are not shared with any outside party, as described in our Privacy Policy.

9. Acceptable use

You agree not to:

• Reverse-engineer, scrape, or bypass quota or access limits.
• Upload photos or information about other people without their consent.
• Harass staff or other users, or misuse the coaching features.
• Resell, redistribute, or commercially exploit the app or its content.
• Use the app for any unlawful purpose.

10. Your content and license to us

• You keep ownership of the photos, notes, profile information, and other content you submit.
• You grant us a limited, non-exclusive license to process your content solely to provide the service — including AI analysis, plan generation, transcription, and review by your assigned service team — as described in the Privacy Policy.

11. Intellectual property

The app, its design, the brand "Saliim", plan templates, and Ahmed Elkhateeb-branded content are owned by us or our licensors and are protected by law. You receive a personal, non-transferable, revocable license to use the app for its intended purpose.

12. Third-party services

The app relies on third-party providers (including Supabase, Google Cloud / Vertex AI, Firebase Cloud Messaging, Agora, and Sentry). Your use of these features may also be subject to those providers' terms. We are not responsible for third-party services we do not control.

13. Disclaimers

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted, error-free, or that any estimate or plan will achieve a specific result.

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for losses arising from network outages or third-party services. Our total liability for any claim is limited to the amount you paid for the app in the 12 months before the claim.

15. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the app, your violation of these Terms, or your infringement of any third party's rights.

16. Suspension, termination, and account deletion

• We may suspend or terminate access for abuse, fraud, or violation of these Terms.
• You may stop using the app and delete your account at any time from Settings / Account → Delete account; deletion takes effect immediately and is irreversible. You can also delete your account at saliim.co/account-deletion.html or by emailing support@saliim.co.

17. Governing law

These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-law rules.

18. Changes to these terms

We may update these Terms. Material changes will be announced in the app and the date above will be updated. Continued use after a change means you accept the updated Terms.

20. Apple App Store — additional terms

These additional terms apply when you download the app from the Apple App Store:

• These Terms are between you and SANTA CO L.L.C-FZ only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide any maintenance or support for the app.
• To the extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims relating to the app (including product liability, legal or regulatory compliance, or consumer-protection claims) are our responsibility, not Apple's.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
